Our Limited License to You.

International Users.

All Content and services are controlled, operated and administered by JACL from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. Indemnification.

Release of Claims.

Class Action Waver.

Any arbitration under these Terms and Conditions will take place on an individual basis and only after 60 days of not reaching resolution of any issue; class arbitrations and class/representative/collective actions are not permitted. You agree that the only method to be used for dispute resolution is binding arbitration before a single arbiter, selected jointly. You also agree that should arbitration take place, it will be held in Pennsylvania, USA. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and JACL agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

If you are dissatisfied with any portion of this JACL Website, or with any of these terms of use, your sole and exclusive remedy is to discontinue using the site.

YOUR CONDUCT

You are agreeing that you will not use our JACL Website or its Conduct in any way that causes or is likely to cause the JACL Website, Content, or access to them to be interrupted, damaged or impaired in any way. Joyce Akiko Consulting, LLC reserves the right to deny a refund and remove access for a student who plagiarizes any material found on a website owned or operated by JACL.

ONLINE COMMERCE

Certain sections of the JACL Website or its Content may allow you to make purchases from us or from other merchants (Merchants). If you make a purchase from us on or through our JACL Website or its Content, all information obtained during your purchase or transaction and all of the information that you give as part of the transaction, such as your name, address, method of payment, credit card number, and billing information, may be collected by both us, the merchant, and our payment processing company.  Please review our Privacy Policy, which can be found at https://joyceakiko.com/privacy-policy/, for how we comply with securing your personal data.

Your participation, correspondence or business dealings with any affiliate, individual or company found on or through our JACL Website, all purchase terms, conditions, representations or warranties associated with payment, refunds, and/or delivery related to your purchase, are solely between you and the merchant. You agree that we shall not be responsible or liable for any loss, damage, refunds, or other matters of any sort that incurred as the result of such dealings with a Merchant.

Payment processing companies and merchants may have privacy and data collection practices that are different from ours. We have no responsibility or liability for these independent policies of the payment processing companies and Merchants. In addition, when you make certain purchases through our JACL Website or its Content, you may be subject to the additional terms and conditions of a payment processing company, Merchant or us that specifically apply to your purchase. Refund Policy.

There are no refunds for services provided by Joyce Akiko Consulting, LLC unless otherwise stated. All services sales are final. For online courses or workshops, there is a 14-day refund policy that can be processed if and only if the following criteria are met:

1. The refund request is made within 14 days of the course/workshop purchase date.

2. The customer provides evidence that they have completed at least half of the course/workshop content 

3. The customer completed at least half of the course/workshop content as determined by our records.

TERMINATION

We reserve the right in our sole discretion to refuse or terminate your access to any JACL Website, Content or related services or any portion thereof that is owned by JACL, in full or in part, at any time without notice. In the event of cancellation or termination, you are no longer authorized to access the part of the JACL Website or Content affected by such cancellation or termination. The restrictions imposed on you in these T&C with respect to this JACL Website and its Content will still apply now and in the future, even after termination by you or us.

If any part of these T&C is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
